These Terms of Service ("Terms") govern your access to and use of takemeoutapp.com, the Take Me Out mobile app, and related services (collectively, the "Services").

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority in your state, you may use the Services only with the involvement of a parent or legal guardian.

2. Description of services

Take Me Out provides itinerary-planning and outing recommendation tools that may use your selected preferences and location to suggest stops, routes, and related planning information. We may modify, suspend, or discontinue any part of the Services at any time.

3. No guarantee of availability, accuracy, or suitability

Take Me Out is intended for general informational and planning purposes only. We do not guarantee:

  • That any recommendation, stop, route, business, or venue will always be available
  • That hours, pricing, availability, ratings, traffic, or business information will always be accurate
  • That any itinerary will be suitable for your preferences, safety needs, schedule, or circumstances

You are responsible for verifying details before relying on them.

4. Location-based features

Certain features rely on location data. You may disable location access through your device settings, but parts of the Services may not function properly if you do.

5. Acceptable use

You agree not to:

  • Use the Services for any unlawful purpose
  • Interfere with or disrupt the Services
  • Attempt to access systems or data you are not authorized to access
  • Copy, scrape, reverse engineer, or exploit the Services except as allowed by law
  • Upload or transmit harmful code, malware, or disruptive material
  • Use the Services in a way that could harm Take Me Out or other users

6. Intellectual property

The Services, including their text, graphics, branding, logos, software, design, and content, are owned by or licensed to Take Me Out and are protected by applicable intellectual property laws. Except as expressly allowed in these Terms, you may not reproduce, modify, distribute, or create derivative works from the Services without our prior written consent.

7. User submissions

If you send us feedback, suggestions, ideas, or other submissions, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and incorporate that feedback for any business purpose, without compensation to you.

8. Third-party services

The Services may integrate with or link to third-party services, including maps, business listings, booking platforms, analytics tools, or email tools. We are not responsible for third-party services or content.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We do not warrant that the Services will be uninterrupted, error-free, secure, or always accurate.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAKE ME OUT AND ITS FOUNDERS, OWNERS, AFFILIATES, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US, IF ANY, IN THE PRIOR TWELVE MONTHS, WHICHEVER IS GREATER.

11. Indemnification

You agree to defend, indemnify, and hold harmless Take Me Out and its affiliates, owners, personnel, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of your use of the Services, your violation of these Terms, or your violation of any law or third-party right.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you violated these Terms or if necessary to protect the Services or others.

13. Governing law

These Terms are governed by the laws of the State of New Hampshire, without regard to conflict of law principles.

14. Dispute resolution

Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in New Hampshire, and you consent to those courts' jurisdiction and venue.

15. Changes to these terms

We may update these Terms from time to time. When we do, we will post the revised version and update the "Last Updated" date. Your continued use of the Services after changes become effective means you accept the revised Terms.
